H.B. 166: Water Rights Amendments






“Uncodified Material”

Effective Date:  May 14, 2013

            A person with a grazing permit on public lands may access and improve the grazing area as necessary to use, develop, and maintain a water right appurtenant to the grazing area (including underground water rights).  Underground water rights claimed by the federal government are to be reported to a legislative committee.  The uncodified material requires a study of the state’s jurisdiction over water rights, including conflicts between private and public right holders, along with proposals for legislation to best maintain and defend the state’s jurisdiction.  The study is due on November 30, 2013.
