H.B. 36: Storm Water Capture Amendments





Effective Date:  May 14, 2013

            Under the language adopted by this bill, the state engineer is prohibited from commencing an enforcement action against a person who captures and stores precipitation, as long as the capture complies with local ordinances, does not interfere with other water rights, and is designed to retain precipitation to protect watersheds.  The bill further clarifies that using precipitation on the same parcel on which it was captured is not a water right, even though the use of the water may be beneficial.  Storage containers may not exceed 2,500 gallons.
